Vietnam to collect tax arrears from online hotel booking services

Foreign-based online accommodation booking services will be the next to be targeted by Vietnamese tax authorities in an effort to improve fair competition for local businesses.

At the end of 2016, Vntrip.vn – a Vietnamese online hotel booking site – publicly accused its rival Agoda.com of having avoided performing its tax duties in Vietnam despite having expanded its operations to the Southeast Asian country.

Agoda.com, a Singapore-based company, has run its Vietnamese version since 2010 and currently cooperates with over 9,200 local hotels and vacation rentals.

According to Le Dac Lam, CEO of Vntrip.vn, the Singaporean booking service pockets as much as 20 percent of the room prices paid by customers to its partner hotels, while not being taxed at all on the income.

The executive estimated that the total revenue of Vietnam’s hotel industry would be around US$21 billion in 2020, 50 percent of which will be coming from online hotel booking services, equivalent to $10.5 billion.

At the commission rate of 20 percent, such foreign-based booking sites as Booking.com or Agoda.com would be bagging billions of untaxed dollars that could have gone to Vietnam’s government budget, Lam said.

Responding to Vntrip’s denunciation, the Vietnamese Ministry of Finance last month issued a dispatch demanding that provincial and municipal tax bureaus impose tax policies on online accommodation booking services provided by foreign companies in Vietnam.

Sites such as Agoda, Traveloka, Booking and Expedia are subject to both value-added tax (VAT) of five percent and a corporate income duty of five percent based on their revenue, the dispatch reads.

The Vietnam-based partners of these companies are responsible for the declaration and payment of tax on their behalf, and the State Bank of Vietnam is to work closely with tax authorities in monitoring the revenue of the firms based on their customers’ transactions, according to the ministry.

In an interview with Tuoi Tre (Youth) newspaper, Nguyen Nam Binh, deputy director of the Ho Chi Minh City Tax Bureau, said foreign entities and individuals who do business in or receive income from Vietnam are subject to foreign contractor tax (FCT), which is basically comprised of VAT and corporate income tax, even if they are not legally represented in the country.

“The dispatch by the Ministry of Finance is just a clarification of this law rather than the introduction of a new one,” Binh explained.

He said Ho Chi Minh City would continue to carry out inspections on local hotels to check their tax compliance and collect tax arrears from all payments made by these hotels to foreign online booking sites.

Ho Chi Minh City to better Singapore in medical services: health chief

Ho Chi Minh City has the potential to outdo Singapore in terms of medical services by as early as 2020 if medical facilities are adequately invested in, the municipal health director said Tuesday.

Speaking at a meeting with the city's leaders, Nguyen Tan Binh, director of the municipal health department, asserted that with sufficient investment and favorable policies, he can promise that the city residents "will no longer have to travel to Singapore or any other country for medical treatment."

According to Binh, with a population of over ten million, Ho Chi Minh City possesses an invaluable depth of medical talent who only require further training to become skilled doctors.

One of the key facilities that Binh looked forward to finishing to further realize his vision is a hi-tech medical complex which is under construction in Tan Kien Commune, Binh Chanh District.

The complex will be able to handle up to 2,600 resident patients, offering hi-tech medical procedures in different specializations including blood
transfusion and hematology, dento-maxillofacial science and dermatology.

In January, a massive children’s hospital, considered Vietnam’s most modern, went into partial operation in Binh Chanh, with its remaining wards scheduled to be inaugurated in the second quarter of this year.

The second campus of Ho Chi Minh City’s Pham Ngoc Thach University of Medicine, which is also under construction in Binh Chanh, is expected to become the facility responsible for training highly skilled medical personnel.

“After 2020, there will be doctors trained to European standards [in the city],” Binh said. “We do not lack human resources; what we do lack is proper investment.”

Binh added that hospitals in the city needed more relaxed policies to allow the adaptation of the public-private partnership (PPP) cooperative arrangement, in which private investors can develop modern medical facilities for those who can afford the service.

“Our Hospital of Oncology won’t be inferior to Singapore’s, while our obstetric and pediatric hospitals have already surpassed theirs [in terms of facility and personnel],” Binh claimed.

Binh said Ho Chi Minh City would soon become the pride of Vietnamese medicine, with the ability to provide medical services on par with those offered in Europe and the U.S.

“And there should be no reason for our citizens to seek medical treatment elsewhere,” he concluded.

Hoi An – Vietnam’s new food capital

Along with the world’s famous markets in Japan and the UK, Hoi An Market in Hoi An Ancient Town, Quang Nam Province, central Vietnam, is known as a “food paradise” for both local and foreign tourists, according to Lonely Planet.

Up to 90% of Vietnamese to have Internet access: IT official

Vietnam is looking to raise its Internet accessibility from just over 50 percent to between 80 and 90 percent of the population, an IT official said Wednesday.

Nearly 50 million Vietnamese, most of whom are young people, currently have access to the Internet, accounting for 53 percent of the country’s population.

Seventy-eight percent of these people use the Internet on a daily basis, according to Nguyen Thanh Hai, director of the Information Security Department under the Ministry of Information and Communications.

At a seminar held on Wednesday in Hanoi on ‘Digital Citizens and Internet Safety,’ Hai said Vietnam’s Internet accessibility is already higher than the world’s average, with 46.64 percent of the world population currently being connected to the Internet.

Vietnam ranks 16th among Asian countries with the most Internet users, according to experts at the seminar.

The country is set to raise its number of Internet users to between 80 and 90 percent of the population in the upcoming years, comparable to the proportion observed in developed countries, Hai said.

“Improving Internet accessibility is the prerequisite of a remarkable growth rate in e-commerce and other socio-economic fields,” said Vu Hoang Lien, chairman of the Vietnam Internet Association.

Such a goal is being challenged by underdeveloped information technology infrastructure, a lack of human resources, information security, and Internet safety and security, Lien added.

Hai warned of existent and varied threats on the Internet that may have a negative impact on the digital environment of Vietnam, such as piracy, intellectual property infringement, and fabricated information.

In 2016, Vietnam saw a number of cyber attacks that demonstrated the vulnerability of its Internet security, Hai said, citing the hacking into announcement screen systems at major Vietnamese airports last July.

In downtown Saigon, officials mount ‘sidewalk reclamation’ campaign against state cars

Authorities in District 1, Ho Chi Minh City have proved that in their ‘sidewalk reclamation’ campaign, which has seen numerous car owners fined for parking their vehicles on the sidewalk, no one stands above the law.

The District 1 administration has sent forces to ensure district-wide sidewalks are not occupied by any construction, street food stall or wrongly-parked car since last week.

The crackdown on Wednesday found several ‘special’ violators – leaders of different regulatory bodies who gathered for a meeting with the municipal administration at the City Hall fronting the Nguyen Hue promenade, where parking is prohibited.

When the leaders were attending the meeting, their drivers would wait outside as usual, not knowing that they would be ‘visited’ by members of the ‘sidewalk reclamation’ team, led by District 1’s deputy chairman Doan Ngoc Hai.

At around 11:00 am, the team came to the Union Square building on Nguyen Hue, where some cars wearing blue license plates, indicating they are state-owned, were parked, with their drivers either sleeping inside or chatting with one another in the shady areas nearby.

All drivers were astonished to see officials coming to inform them of the wrong parking, before starting to make excuses, including one that they were waiting for leaders of city-level bodies.

One driver said he was waiting for the leader of the city's Steering Center of the Urban Flood Control Program, which however did not help him get away from a ticket.



Another chauffeur said he did not mean to park his car in the wrong place, but was told to do so by the guards in front of the City Hall, as the allowable parking space there had been full.

The driver was pleading with the District 1 officials for a break when his boss, deputy chairman of the District 9 administration, showed up.

The District 9 leader then talked to his District 1 counterpart asking not to be fined for that “first-time violation.”

However, Hai, the District 1 deputy chairman, insisted that the case be booked as per the law.



As observed by Tuoi Tre (Youth) newspaper reporters, Hai and his team managed to book four cars carrying blue license plates for wrong parking in the 30-minute crackdown.

A traffic police officer from the inspection team revealed that the wrong-parking violation is subject to fines between VND600,000 (US$26) and VND800,000 ($35), regardless of the violators being public servants or citizens.

The inspectors also towed away one car that was parked in the wrong place, in the absence of its driver.

The team then came to Nam Ky Khoi Nghia Street and booked nine cases of wrong parking, compared to six violators they caught the whole day before.
Deputy chairman Hai has publicly vowed to step down if this ‘sidewalk reclamation’ campaign fails.
